4.Conclusion of Contract

By ordering through this website and accepting these conditions, the customer makes a legally binding offer to conclude a contract. MARYNA MARII KOSMETIK STUDIO then automatically sends a confirmation of the order receipt by email, confirming the receipt of the customer's offer by MARYNA MARII KOSMETIK STUDIO. Orders placed are binding for the customer. Unless otherwise specified, returns or the right of withdrawal are not provided.

5.Payment Options and Retention of Title

MARYNA MARII KOSMETIK STUDIO may charge interest on arrears of 5% per year and reminder fees of a maximum of CHF 10 for each reminder in case of payment delay.
The delivered products remain the property of MARYNA MARII KOSMETIK STUDIO until full payment.
6.Delivery, Inspection Obligation, Complaint, and Return
Deliveries are made by mail or courier service to the address specified by the customer in the order.
MARYNA MARII KOSMETIK STUDIO aims to adhere to minimal delivery times (https://mareyshop.ch/delivery). However, the delivery times indicated in the order confirmation letter are to be understood as approximate. MARYNA MARII KOSMETIK STUDIO reserves the right to partial deliveries. In this case, the shipping cost will be calculated only once for the customer.
Invoicing, if payment by invoice is provided, will be done at the discretion of MARYNA MARII KOSMETIK STUDIO by email or postal mail.
If delivery is impossible or the customer refuses to accept the delivery, MARYNA MARII KOSMETIK STUDIO may terminate the contract after notifying the customer by email and observing a reasonable period, and also invoice for the costs.
The customer is obliged to check the delivered goods immediately upon receipt and promptly notify any defects, for which MARYNA MARII KOSMETIK STUDIO is responsible, in writing to the address specified in the imprint (https://mareyshop.ch/impressum).
7.Right of Withdrawal
The buyer has the right to withdraw from the contract within 14 calendar days of receiving the goods. The deadline is considered met if the buyer sends a written notice of withdrawal by email or post to MARYNA MARII KOSMETIK STUDIO during this period (the address is specified in the imprint). The withdrawal does not require justification.
The withdrawal of the contract leads to the termination of the contract. The buyer must return the goods within 14 calendar days in the original packaging, unopened and complete, accompanied by a delivery note, to the address specified in the imprint for the return of goods to MARYNA MARII KOSMETIK STUDIO. The return of the goods to MARYNA MARII KOSMETIK STUDIO is at the cost and risk of the buyer. If MARYNA MARII KOSMETIK STUDIO has already received the goods or the buyer can provide proof of the shipment of the goods, the payment already made will be refunded to the buyer within 20 calendar days.
MARYNA MARII KOSMETIK STUDIO reserves the right to demand reasonable compensation for damages, excessive wear, or depreciation due to improper handling and to deduct or invoice the buyer the amount of the depreciation from the already paid price.
The right of withdrawal is not granted in the following cases:
If the contract contains an accidental element, especially if the price is subject to fluctuations beyond the control of the supplier.
If the contract concerns digital content and this content is not provided on a physical medium or if the contract must be fully and immediately fulfilled by both parties with the explicit consent of the buyer.
If the contract concerns a service and the supplier must fully fulfill the contract before the expiration of the withdrawal period with the explicit consent of the buyer.
Defective goods are excluded from this.
If the check by MARYNA MARII KOSMETIK STUDIO shows that the goods have no detectable defects or they do not fall under the manufacturer's warranty, MARYNA MARII KOSMETIK STUDIO may invoice the buyer for the costs of return, processing, or, if necessary, disposal of the goods.
8.Warranty

9.Warranty
MARYNA MARII KOSMETIK STUDIO strives to deliver goods of impeccable quality.
9.1 If the goods have defects, the statutory warranty provisions for goods apply. Excluded from this exception are: Warranty claims do not arise from normal wear and tear or damage that occurred after the transfer of risk due to improper or negligent treatment, excessive stress, improper use, or due to special external influences that are not provided for in the contract. If the customer or third parties have made improper changes or repairs, no warranty claims are provided for them and the resulting consequences unless the customer can prove that the claimed defects were not caused by these changes or repairs.
9.2 The limitation period for warranty claims for new goods is one year from the transfer of risk. For used goods, rights and claims due to defects are excluded.
9.3 The above-mentioned limitations of liability and shortening of the limitation period do not apply:
for items that have been used according to their normal purpose for a building and caused its defectiveness, for claims of the customer for compensation and reimbursement of expenses,
in case the seller intentionally concealed the defect.
The warranty does not extend to normal wear and tear, as well as to the consequences of improper handling or damage by the customer or third parties, as well as to defects caused by external circumstances. Consumables and wear parts (e.g., batteries, accumulators, etc.) are also excluded from the warranty.
10.Liability
MARYNA MARII KOSMETIK STUDIO disclaims any liability, regardless of its legal basis, as well as claims for damages against MARYNA MARII KOSMETIK STUDIO and possible assistants and agents. MARYNA MARII KOSMETIK STUDIO is not liable, in particular, for indirect damages and consequential damages, loss of profit, or other damages to persons, property, and pure financial losses of the customer. This exclusion does not apply to mandatory legal liability, such as gross negligence or intentional unlawful intent.
11.Data Protection
MARYNA MARII KOSMETIK STUDIO may process and use the data obtained during the conclusion of the contract to fulfill the obligations of the purchase contract as well as for marketing purposes. Data required for the provision of services may be disclosed to service partners (logistics partners) or other third parties.

12.Invalidity
Should individual provisions of these terms be ineffective or unenforceable, this does not affect the validity of the remaining provisions.

In the event of disputes, Swiss substantive law applies exclusively, excluding conflict of laws. International sales law (UN Sales Law, Vienna Convention on Contracts for the International Sale of Goods) is expressly excluded.
The place of jurisdiction is the place of residence court of MARYNA MARII KOSMETIK STUDIO or the place of residence of the consumer.
14.Eyelash Extension Course
Registration:
The training date is reserved upon receipt of the deposit; otherwise, the date is released without notification.
Cancellation of Registration:
The cancellation of the registration must be in writing and must be made at least 14 days before the start of the course.
In case of late cancellation, the deposit will not be refunded.
